Terms and Conditions

By using the Defenders’ Database you are agreeing to the following Terms and Conditions: Civil Rights Defenders reserves the right to update and change them without notice. Violation of any of the terms below may result in the termination of your account.

Purpose of the Defenders’ Database

The Defenders’ Database is designed to be a working tool for human rights defenders to record violations committed against them or others in their work to promote, defend and protect human rights. It is not permitted to use the tool for any other purpose, and it is under no circumstances allowed to knowingly record false or inaccurate information, use the material or the tool to instigate violence, harass others or commit any other action contrary to the purpose of the tool. If proven that this has occurred, Civil Rights Defenders will terminate the account/s involved in breaching the terms.

Account Terms

The account holder is responsible for maintaining the security of the account and password. Civil Rights Defenders will not be liable for any loss or damage from failure to comply with this security obligation.

The user is responsible for all the data submitted onto the Defenders’ Database and the activity that occurs under his or her account.

It is not permitted to use the Defenders’ Database to violate any laws under Swedish jurisdiction, Irish jurisdiction or GDPR (including but not limited to copyright laws).

You must provide your full legal name, a valid email address and the name of your organisation in order to become a certified user.

Your login may only be used by one person. A single login shared by multiple people is not permitted.

Terms for registered and certified users

As a registered user, you may use the Defenders’ Database offline tool freely for your own needs by downloading it from the webpage. If you are interested in becoming a certified user in order to gain access to additional features you are required to get in contact with Civil Rights Defenders at database@civilrightsdefenders.org and we can discuss the details.

By becoming a certified user you will be eligible to participate in trainings and human rights activities with Civil Rights Defenders.

Cancellation and Termination

You are solely responsible for properly canceling your account. You may contact us at database@civilrightsdefenders.org if this is the case.

All of your personal data will be inaccessible from Defenders’ Database immediately upon cancellation, unless otherwise is agreed.

Civil Rights Defenders has the right to suspend or terminate your account and refuse any or all current or future use of the Defenders’ Database if misuse (intended fake reports, double reporting or inaccurate reports) of the system has been detected.

Bullying, racism and sexism is not tolerated among our users and if such behaviour is discovered it can lead to termination of the account/s.

Changes in the database

Civil Rights Defenders reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any part of the Defenders’ Database with or without notice. This will however not affect data stored in the database.

Civil Rights Defenders will not be liable to you or to any third party for any modification, suspension or discontinuance of the Defenders’ Database.

Copyright and Content Ownership

All uploaded reports must comply with Swedish and Irish jurisdiction.
We claim no intellectual property rights over the reports you provide to the Defenders’ Database. All material uploaded remain yours or your organisation’s.

Civil Rights Defender does not quality check reports in the Defenders’ Database, but reserves the right (but not the obligation) to remove any content if found fake or illegal under Swedish and Irish law.

Civil Rights Defenders has the right to use the data from the partner’s data set in reports, articles or other texts that will be published to the public. This will be done in accordance with the consent given by individuals in the reports. The partner will be informed beforehand and the data will always be presented with reference to the source.

General Conditions

Civil Rights Defenders regards the safety of your data as a top priority and we monitor all activity. However, using the Defenders’ Database is is at your sole risk.
Technical support is only provided by email or through the contact form on the platform.

You understand that Civil Rights Defenders uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Defenders’ Database.

You must not modify, adapt or hack the Defenders’ Database.

You must not modify another website so as to falsely imply that it is associated with the Defenders’ Database or Civil Rights Defenders.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Defenders’ Database, use of the Defenders’ Database, or access to the Defenders’ Database without a written permission by Civil Rights Defenders.

We may, but have no obligation to, remove content and accounts that we determine are unlawful or violate the Terms and Conditions.

Verbal, physical, written or other forms of abuse (including threats of abuse or retribution) of any Defenders’ Database user will result in immediate termination of account.

You understand and agree that Civil Rights Defenders will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of reports, use, data or other intangible losses (even if Civil Rights Defenders has been advised of the possibility of such damages), resulting from:
1. The use or the inability to use the system,
2. Unauthorised access to or alteration of your transmissions or data,
3. Statements or conduct of any third party on the service,
4. Or any other matter relating to the Defenders’ Database.

The failure of Civil Rights Defenders to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. The Terms and Conditions constitutes the entire agreement between you and Civil Rights Defenders and govern your use of the Defenders Database.
